A female prison guard in Berlin has been fined nearly EUR 10,000 after being caught performing a sex act on a convicted rapist in the prison printing office.

The incident took place at Tegel Prison (Justizvollzugsanstalt Tegel) in the German capital Berlin on 9th April 2020, and she has now been convicted and fined nearly EUR 10,000 (GBP 8,350).

It was not the first time that the defendant, who has not been named due to strict local privacy laws, had been caught having intimate relations with a convicted criminal.

German media report that 15 years ago, she had sex with a prisoner from another prison and became pregnant. It is unclear if she carried the pregnancy to term.

Under German law, even if the sexual act she performed on the prisoner was consensual, prison employees are forbidden from abusing their position of power, which the officer is considered to have done by performing oral sex on the inmate.

The convict on whom the defendant performed the sex act was jailed in 2000 after he was convicted of having locked a 20-year-old woman, who has not been named, in the boot of his car before raping her for hours in a forest. That was reportedly just 10 days after he was released from prison, where he had served a sentence for another crime.

Experts have said that the convict, who has not been named either, on whom the prison guard performed the sex act is “highly dangerous”.

The verdict is not binding and the defendant has appealed. The prison inmate, who is technically considered the victim, was also reportedly supposed to testify as a witness, but the district court cancelled his appearance without providing a reason.
