Mum, 25, Jailed For Throwing Newborn Baby In The Bin On Christmas Day

A 25-year-old woman has been jailed for three years for throwing her newborn baby in a rubbish bin on Christmas Day.

Jasmin H., from the city of Regensburg in the German state of Bavaria, was charged with murder after she threw her newborn daughter in the rubbish on 25th December 2020.

During the final day of the trial, which took place on 27th August, the mother was sentenced to three years imprisonment for negligent murder.

According to local media, Jasmin, who worked as a geriatric nurse, was raised in an unstable household as both of her parents were alcoholics and frequently moved from one place to another during her childhood.

In addition, the woman changed relationships and sexual partners frequently, and had a child from a previous relationship who is living with foster parents, according to reports.

On the day of the incident, the 25-year-old woman gave birth to the baby girl around noon in the toilet of her shared apartment on the outskirts of Regensburg.

She then put the seemingly unconscious child in a plastic bag and dumped her in an outside bin.

However, when her flatmates came home they discovered a pile of bloody towels and confronted Jasmin, who claimed the child was stillborn.

Her flatmates urged her to go to hospital where she later told doctors she suffered a stillbirth.

When asked where the dead child was, the defendant replied that she flushed it down the toilet and stated: “I didn’t want to have a child anyway.”

Her flatmates were suspicious of her claims and alerted the police, who found the dead child in the rubbish bin and arrested Jasmin.

During the trial, Jasmin said she thought the child was already dead when it was born, however an autopsy showed that the girl was alive for at least half an hour after delivery.

According to the autopsy report, the girl died of oxygen deprivation, hypothermia, or a combination of both.

Judge Michael Hammer, 56, said: “We do not know when the child died, how she died, whether she was actively suffocated, or whether she suffocated or froze to death in the bag due to lack of air supply.”

However, he added: “If the mother wanted the child, the girl would be alive today.”
