German professional boxer Tom Schwarz has been ordered to pay a EUR-2,500 fine for breaking his ex-girlfriend’s jaw in three places after the judge said she had been complicit.
Schwarz, 27, who once faced off against two-time world heavyweight champion Tyson Fury, reportedly faced 10 years in prison because the prosecutor considered his fists to be a weapon, given his considerable expertise with using them.
The incident allegedly occurred in a parking area in front of a pizzeria in the village of Lostau in the German state of Saxony-Anhalt on 31st May 2020 and shocking images show the injuries sustained by Schwarz’s ex after he allegedly knocked her to the ground during a heated row.
But Judge Winfried Leopold, who presided over the trial in the district court in the German town of Burg, in the state of Saxony-Anhalt, yesterday (Tuesday 9th November) deemed that Schwarz’s ex-girlfriend Tessa Schimschar, 28, had been “partially complicit” in the incident, according to German news magazine Focus.
He reportedly cried tears of relief after the ruling while his ex-girlfriend left the courtroom in silence.
The proceedings against Schwarz for dangerous bodily harm were discontinued after almost five hours of negotiations, resulting in nothing more than a EUR-2,500 (GBP-2,134) fine for the boxing champion.
Judge Winfried Leopold said: “There was misconduct on both sides. He is the master of the flying fists and not the master of the spoken word.”
She added: “The punch could and should have been carried out differently and as a professional boxer, you have to be able to dose it. But your ex-girlfriend did not do cover herself in fame either.”
Leopold did not consider that a case had been made for dangerous bodily harm, saying: “The statements made in the main hearing are not sufficient for this.”
The judge also suggested a certain degree of complicity on behalf of Schimschar, saying: “She couldn’t really explain why she followed him.”
Schimschar’s statement said that she wanted to settle the argument, but a witness also stated that she had hit the boxer, according to Focus.
Schwarz’s lawyer Stefan Conen even attempted to move for an acquittal, saying: “In my opinion, there was an act of self-defence, as my client was cramped in his Range Rover and had nowhere to go. I see there being chances of an acquittal.”
But in the end, he was ordered to pay a fine of EUR 2,500.
It is unclear if the ruling will be appealed.
