Woman Sues Surgeon For Removing Labia Instead Of A Trim

A woman has been awarded GBP 13,700 in damages from her plastic surgeon after he removed her entire labia when she only wanted it trimmed.

The trial took place in the town of Feldkirch in the western Austrian state of Vorarlberg, after the claimant said that her surgeon removed her labia during the labiaplasty procedure in which she only wanted around one centimetre trimmed off.

News site Tag 24 said that the plastic surgeon was also accused of cutting the woman’s clitoris during the procedure, leaving behind an unsightly scar.

This was considered medical malpractice, and according to a gynaecological expert, it also amounted to genital mutilation.

During the trial at the Feldkirch Regional Court, it emerged that the patient had problems with sexual intercourse after the operation, and she described finding it enormously difficult to orgasm ever since.

The allegedly bungled operation also left the woman’s private parts open to a greater risk of infection.

However, the unnamed surgeon maintained his innocence, and said that the patient came to him about itching and burning in her labia. He deemed its removal medically necessary.

The gynaecological expert admitted that he should have discussed this with the patient first to make it clear what needed to happen.

The claimant initially asked for EUR 40,000 (GBP 36,585 ) in damages.

In the end, both parties reached an agreement and the injured woman will receive EUR 15,000 (GBP 13,700 ) in compensation while both parties will pay their own legal fees.
