A man claiming to be bisexual is being sued by his ex-wife for allegedly hiding his homosexuality from her.

The couple, who were married for three years after dating for two, were divorced nine years ago by mutual agreement.

But the angry woman, identified only by her initials of M. J. R., is now back in court in the Spanish city of Valencia in the autonomous community with the same name after finding out that her ex-husband hid the fact that he was homosexual from her.

She says that the marriage was never valid in the first place because her ex-husband, identified as lawyer Javier Vilalta, hid the fact that he was gay and she wants it declared void.

As well as having the marriage annulled, she also wants EUR 10,000 (GBP 9,103) in compensation for “financial and moral” damage caused by his alleged deceit.

The written accusation names two friends that the former couple have in common that “knew about his homosexuality” and claims Vilalta also knew but had kept it secret since his childhood and had relations with another man which M. J. R. later “corroborated” over the telephone.

It is unclear when Vilalta’s alleged relations with the man occurred.

It adds the ex-wife “would not have consented” to the marriage had she known the defendant “deliberately” hid his homosexuality from her.

Vilalta, who says he did not realise he was bisexual until after the marriage, spoke with local newspaper El Pais and said his relationship was not affected by his sexual orientation.

He added that even if he had been involved with another man, it was his own business and he added he “does not think that I owe anybody any explanations”.

Vilalta, who is a human rights lawyer, thinks “the worst part of this case” is that it “jeopardizes several fundamental rights along the way”.

He added the fact that the cases even going ahead is proof that “that neither liberty nor sexual equality exist”.

He made a post on his social media saying he hopes the case helps “modify the current legislation” hoping that it “does not happen to anyone else”.

There have been no comments outside of the legal matter by M. J. R. or her lawyer.

The current state of the lawsuit is unclear.
