A steakhouse sued by Burger King for saying it made the world’s best burgers has been cleared of telling whoppers by judges in Brazil.
The burger giant had gone to court claiming that Madero Groupo should be made to prove their claim.
Now the seven-year legal battle has been lost by the US chain after Brazil’s Superior Court of Justice ruled that Madero had no case to answer.
The final decision reverses an earlier verdict that supported Burger King’s claims that the Brazilian company, which says in its advertising that it makes the “best burgers in the world”, should be made to prove that they do.
Groupo Madero says on its website that the company is built around Junior Durski, a self-taught chef.
They hail Durski as the soul of the Madero Group, which runs 270 steakhouses across Brazil.
Junior Durski said on Instagram on Tuesday, 21st March: “The Superior Court of Justice (STJ) denied this Tuesday (21) a request by Burger King for Madero to prove to have ‘the best hamburger in the world’, as it says in [our] advertising campaigns.
“The fast food chain wanted an expert test to be carried out, to prove or disprove the statement.
“The dispute has been going through the courts for years.
“Burger King obtained a favourable decision in the first instance of the Justice of Sao Paulo, but Madero reversed the determination in the Court of Justice (TJ-SP).
“Burger King appealed to the STJ, but the TJ’s decision was unanimously upheld by the Third Panel of the court, made up of five ministers.”
Many of Durski’s 144,000 followers were delighted at the victory, with many saying Madero’s burgers are in a league of their own.
